***Clause 1: Postponement of the occupation date ***
The tenant recognizes that the anticipated date of occupancy (date of commencement of the lease) indicated in Section C of the lease is approximative.
If the landlord is unable to respect the target occupancy date, the landlord undertakes to advise the tenant in writing a minimum of 60 days in advance.
In this case, in order to fix a new date the following rules will apply.
The new occupancy date cannot be more than ninety (90) days after the original target occupancy date.
If the landlord fails to advise the tenant of the new date in the manner described in 1.a: The tenant may at their discretion cancel the lease and any deposits paid to the landlord will be returned with no other recourse from either party.
